License Revenue Accounts for Supported PSU Copyright Materials

Some PSU Copyright Materials are most impactful as ongoing projects which require regular development and support activities to ensure effective use by Licensees; these projects are most often maintained by the original disclosing Faculty, Staff, or affiliated Department/Center and may require personnel, equipment, or other resources to effectively support the Licensees’ use of the PSU Copyright Materials.

Revenue Distribution and Use

As anticipated by the PSU Copyright Ownership Policy section VI.2.1.2, IIP generates license revenue intended to support deployment of PSU Copyright Materials that are under continual development within the University by licensing the PSU Copyright Materials to third parties for a fee. IIP distributes 90% of the associated licensing revenue to an internal license revenue account (LRA) controlled by the lead Faculty or Staff member responsible for overseeing development of the licensed PSU Copyright Materials and related activities supporting the use of the PSU Copyright Materials by Licensees. License revenue received by IIP during the current quarter is distributed to LRAs four times annually at quarter close. 

LRA funds are not part of an employee's official compensation for work performed at PSU. Rather, they are funds allocated to support activities associated with developing and supporting the use of PSU Copyright Materials by Licensees. While Faculty or Staff may direct the use of these funds, they remain PSU funds and must be expended in compliance with the Copyright Policy, and all other PSU rules and policies.

Fund Balance Information

Departmental fiscal officers and the Faculty or Staff responsible for managing the funds will be notified of distributions to the LRA. Any funds remaining in the LRA at fiscal year-end will “roll over” into the next fiscal year. It is the responsibility of the responsible Faculty or Staff member to not overspend the LRA. If the LRA is overspent at year-end, it is the responsibility of the Faculty or Staff member’s department/college/center to eliminate the deficit.

Fund Disposition at Expiration or Termination of License

In circumstances where the PSU Copyright Materials are no longer being continually developed or if the support activities which enable use by the Licensee(s) are no longer possible or not occuring, the remaining funds in the LRA will revert to IIP. Partial reversion of the LRA funds may be requested, and will be considered/approved at the sole discretion of IIP.
