What should I do if an employee is not cooperating in providing information to assist in administering a Family Medical Leave or when performance concerns unrelated to the leave develop?
Employee leaves are complicated and involve a number of different federal and state laws. Supervisory staff should contact HR Benefits for guidance and assistance in addressing employee FMLA/OFLA issues. Remember, absences for the FMLA/OFLA reason cannot be disciplined because those absences are protected by the leave laws. If there are other performance or attendance issues, HR Benefits may refer you to HR Employee Relations.
