IP Policies and Guidelines: to whom they apply
The PSU Intellectual Property Policies and Guidelines apply to all PSU employees, and to all students and visitors who use significant university resources in the creation of their intellectual property.
The OAR and IMD apply to all employees working for PSU (OAR 580-43-0006, 580-43-0011, and IMD 6.205). In addition to regular employees, the policies also explicitly apply to graduate teaching assistants, graduate teaching fellows, graduate research assistants, and student employees (OAR 580-43-0011).
In general, PSU does not assert ownership over intellectual property developed by students who are not employees, especially if the intellectual property is developed as a part of a class. However, in cases where students have used university facilities, personnel, or other resources to create an invention or develop copyrighted materials, the university may assert ownership as if the student was an employee (IMD 6.205).
Visitors to the university are subject to the policies in the same way students are – the university may assert ownership if they have used university facilities, personnel, or other resources (IMD 6.205).
